Privacy Policy

1. Introduction

GIGDATA LLC ("Company," "we," "us," or "our") operates UIPing ("Service"). This Privacy Policy describes how we collect, use, disclose, and protect your personal information when you use our Service. By using UIPing, you consent to the practices described in this Privacy Policy. If you do not agree with this policy, please do not use the Service.

2. Information We Collect

Information You Provide

  • Account information: email address, full name, and password
  • Monitor configuration: URLs you choose to monitor and notification preferences
  • Payment information: processed securely through Stripe — we do not store credit card numbers
  • Communications: any messages you send to us via email or our contact form

Information Collected Automatically

  • IP address: collected with each request for rate limiting, abuse prevention, and security monitoring. Your IP address is stored in server access logs and recorded with login attempts in our login history system.
  • Login history: we record login attempts (including IP address, user agent, timestamp, and success/failure status) for security monitoring and fraud detection
  • Usage data: features used, monitors created, notification preferences, and service interactions
  • Cookies: we use essential cookies for authentication and session management only (see Section 5)
  • Analytics data: we use Umami, a privacy-focused, cookieless analytics service (see Section 5)

3. How We Use Your Information

We use the information we collect to:

  • Provide, operate, and maintain the Service
  • Process your subscription and payments
  • Send you monitoring notifications and service-related communications
  • Send you marketing communications about our services and related products (you may unsubscribe at any time)
  • Respond to your inquiries and provide customer support
  • Detect, prevent, and address technical issues, fraud, or abuse
  • Monitor login activity for unauthorized access to your account
  • Improve and optimize the Service
  • Comply with legal obligations

4. Information Sharing and Disclosure

We do not sell, rent, or trade your personal information. We may share your information only in the following circumstances:

  • Service providers: We use third-party services to help operate UIPing. See Section 11 for the full list of data processors.
  • Legal requirements: We may disclose your information if required to do so by law or in response to valid legal process, such as a subpoena, court order, or government request.
  • Protection of rights: We may disclose information when we believe it is necessary to protect our rights, your safety, or the safety of others, or to investigate fraud.
  • Business transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.

5. Cookies, Analytics, and Tracking

Session Cookies

We use essential cookies for authentication and session management. These cookies are strictly necessary for the Service to function, do not track you across other websites, and expire when you log out or after a period of inactivity.

Analytics (Umami)

We use Umami, a privacy-focused analytics platform, to understand aggregate usage patterns. Umami is fundamentally different from tracking-based analytics services:

  • No cookies — Umami does not set any cookies on your device
  • No personal data — Umami does not collect IP addresses, device fingerprints, or any personally identifiable information
  • No cross-site tracking — Umami does not track you across websites
  • Aggregate only — all data is aggregated and cannot identify individual visitors
  • Self-hosted — our Umami instance runs on our own infrastructure

Because Umami is cookieless and does not collect personal data, no cookie consent banner is required for its use under GDPR, ePrivacy Directive, or CCPA.

What We Do Not Use

We do not use Google Analytics, Facebook Pixel, advertising cookies, tracking pixels, browser fingerprinting, or any invasive tracking technology.

6. Data Retention

We retain your personal information for as long as your account is active or as needed to provide you the Service:

  • Account data: Retained for the duration of your active account
  • Monitor snapshots and change history: Retained for the duration of your active subscription
  • Login history: Retained for 90 days for security monitoring purposes
  • Server access logs: IP address logs retained for up to 30 days
  • Payment records: Retained as required by tax and financial reporting obligations (typically 7 years), managed by Stripe
  • Analytics data: Umami data is aggregated and contains no personal information; retained indefinitely

If you close your account, we will delete or anonymize your personal information within 30 days, except where we are required to retain it for legal or compliance purposes.

7. Data Security

We implement reasonable technical and organizational measures to protect your personal information, including:

  • Encrypted data transmission (TLS/SSL) on all connections
  • Secure password hashing using bcrypt
  • Database access restricted to application servers only
  • Infrastructure protected by Cloudflare WAF and nftables firewalls
  • Payment data handled entirely by Stripe (PCI DSS Level 1 certified)
  • Access to production systems restricted to authorized personnel

No method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

8. Email Communications

Transactional Emails

Account verification, password reset, subscription confirmations, and monitor notifications. These are necessary for the Service and cannot be opted out of while your account is active.

Marketing Communications

We may send you information about UIPing features, product updates, and related services (including other products operated by GIGDATA LLC, such as WCAG Repair, Abby SEO, AI-Signed, and SiteDialect). You may unsubscribe from marketing communications at any time using the unsubscribe link included in every email. Unsubscribe requests are processed promptly and are permanent unless you re-subscribe.

9. Cross-Site Promotions

Our website may display links or promotional content for related services operated by GIGDATA LLC, including WCAG Repair, Abby SEO, AI-Signed, SiteDialect, and NewSiteLead. These are separately operated services with their own privacy policies. Clicking a link takes you to that service's website, governed by its own privacy practices. We do not share your personal data with these related services for their independent use.

10. Your Rights Under California Law

If you are a California resident, you have certain rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), including the right to:

  • Know what personal information we collect and how it is used
  • Delete your personal information, subject to certain exceptions
  • Opt out of the sale or sharing of your personal information — we do not sell your personal information
  • Non-discrimination for exercising your privacy rights
  • Correct inaccurate personal information

11. Data Processors and Sub-Processors

We use the following third-party service providers (sub-processors) to help operate UIPing. Each processes personal data only as necessary to provide their service to us:

  • Stripe, Inc. — Payment processing (billing address, payment method, transaction history). Stripe is certified under the EU-US Data Privacy Framework. See Stripe's Privacy Policy.
  • MXRoute — Transactional and notification email delivery (email address, message content). Emails are transmitted over TLS-encrypted connections.
  • Cloudflare, Inc. — CDN, DDoS protection, and DNS. Cloudflare processes request data (IP addresses, headers) to provide security and performance services. See Cloudflare's Privacy Policy.

We have data processing agreements (DPAs) or equivalent contractual commitments with each sub-processor. If you require a copy of our DPA or have questions about our sub-processors, please contact us at support@uiping.com.

12. Legal Basis for Processing (GDPR)

If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, we process your personal data under the following legal bases:

  • Contract (Art. 6(1)(b)): Processing necessary to provide the Service, manage your account, process payments, and deliver notifications you configured
  • Consent (Art. 6(1)(a)): Processing based on your explicit consent, such as marketing emails — you may withdraw consent at any time
  • Legitimate Interest (Art. 6(1)(f)): Processing necessary for our legitimate interests, such as improving the Service, preventing fraud, login monitoring, and ensuring security
  • Legal Obligation (Art. 6(1)(c)): Processing necessary to comply with applicable laws, regulations, or legal processes

13. Your Rights Under GDPR

If you are located in the EEA, UK, or Switzerland, you have the following rights:

  • Access (Art. 15): Request a copy of the personal data we hold about you
  • Rectification (Art. 16): Request correction of inaccurate personal data
  • Erasure (Art. 17): Request deletion of your personal data — you can delete your account from your account settings
  • Restriction (Art. 18): Request that we restrict the processing of your personal data
  • Data Portability (Art. 20): Request your data in a structured, machine-readable format
  • Object (Art. 21): Object to the processing of your personal data based on legitimate interests
  • Withdraw Consent: Where processing is based on consent, you may withdraw it at any time

To exercise any of these rights, contact us at support@uiping.com. We will respond within 30 days. You also have the right to lodge a complaint with your local data protection authority.

14. International Data Transfers

UIPing is operated from the United States. If you access the Service from outside the United States, your personal data will be transferred to and processed in the United States. We use Stripe for payment processing, which may process data in the United States and other jurisdictions. By using the Service, you consent to the transfer of your information to the United States. We take reasonable steps to ensure your data is treated securely and in accordance with this Privacy Policy.

15. Do Not Track

We do not track users across third-party websites. The Service does not respond to "Do Not Track" browser signals, as there is no industry-standard technology for honoring such signals. We do not use third-party advertising or analytics tracking cookies.

16. Children's Privacy

The Service is not intended for use by individuals under the age of 18. We do not knowingly collect personal information from children. If we learn that we have collected personal information from a child under 18, we will take steps to delete that information promptly. If you believe a child has provided us with personal information, please contact us at support@uiping.com.

17. Third-Party Links

The Service may contain links to third-party websites, including the product pages you choose to monitor and related GIGDATA LLC services. We are not responsible for the privacy practices or content of those third-party sites. We encourage you to review the privacy policies of any sites you visit.

18. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on this page and updating the "Last Updated" date. For active subscribers, material changes will be communicated by email at least 14 days before they take effect. Your continued use of the Service after any changes constitutes acceptance of the updated policy.
